Job Description

About the role

We are hiring our first General Counsel and Head of Regulatory Affairs, a founding member of our leadership team who will define how Basic Capital operates within and innovates beyond traditional financial regulation.

Basic Capital is building the future of retirement investing in the most regulated arena in America: financial services.

That means we need a creative, fast, deeply strategic General Counsel who thrives in ambiguity, enjoys being close to the action, and can find legal solutions in unexpected places.

A Wartime Consiglieri, Not a “Department of No.”

This is a role for someone who wants to help define a brand-new category, not just interpret old rules.

You will report directly to our Co-Founder and CEO, Abdul Al-Asaad, and partner with leaders across the business to ensure every strategic move, from credit products to partnerships to platform design, aligns with our long-term vision and the regulatory frameworks that govern financial markets.

This is not a typical in-house legal job. It is an opportunity to build the legal and regulatory foundation of a fintech company redefining the rules of retirement investing. You will have direct influence on how we scale, structure, and grow, balancing innovation and compliance every step of the way.

What you’ll do

  • Design and own the company’s legal and regulatory strategy from the ground up

  • Manage outside counsel and legal budget, deciding when to build, when to buy, and when to push for new precedent

  • Negotiate and structure credit and financing agreements that power our capital model

  • Navigate the complexities of custodial relationships, broker-dealer registration, and credit regulation

  • Draft and negotiate commercial contracts such as MSAs, NDAs, and partnerships

  • Ensure our products and platforms stay compliant with federal and state laws across securities, lending, and privacy

  • Create internal policies and controls that keep us efficient, secure, and audit-ready

Who you are

  • JD from an accredited law school and admitted to at least one U.S. bar, open to registering in New York

  • 5 to 10 years of relevant experience in corporate, securities, or tax law, ideally with fintech exposure

  • Deep understanding of regulatory frameworks across capital markets, ERISA and retirement, credit, and data privacy

  • Confident in presenting complex regulatory strategy to business leaders and helping them act on it

  • Entrepreneurial by nature, comfortable operating autonomously, solving new problems, and building structure from zero

  • Based in or willing to relocate to New York City
