Senior Legal Counsel — Competition Enforcement
Position Overview
Job Description
The Commerce Commission is seeking a Senior Legal Counsel for its Competition branch in Wellington. The Commission is New Zealand's primary competition and consumer protection regulator, enforcing the Commerce Act 1986 and Fair Trading Act 1986. You will investigate and litigate anti-competitive conduct, review mergers, and contribute to market studies shaping New Zealand's competitive landscape.
Key Responsibilities
- Investigate potential breaches of the Commerce Act 1986 including cartel conduct (s30), anti-competitive agreements (s27), and misuse of market power (s36)
- Prepare and run enforcement proceedings in the High Court, including penalty applications and injunctions
- Review merger and acquisition clearance applications under Part 3 of the Commerce Act
- Conduct market studies into competition issues affecting New Zealand consumers (groceries, building supplies, fuel)
- Advise on Commerce Commission authorisations and the public benefit test
Requirements
- Admitted as a Barrister and Solicitor of the High Court of New Zealand with a current Practising Certificate
- 6-9 years PQE in competition law, commercial litigation, or regulatory enforcement
- Deep knowledge of the Commerce Act 1986 and Fair Trading Act 1986
- Litigation experience in the High Court preferred
- New Zealand citizenship or permanent residency (security vetting may be required)
