Global Business & Fund Structuring Barrister — Appleby Mauritius

Appleby, one of the world's leading offshore law firms, seeks a Senior Barrister for its Global Business and Investment Fund practice at its Ebene Cybercity office. The firm's Mauritius practice sits at the intersection of offshore structuring and Mauritius's robust regulatory framework under the Financial Services Commission (FSC).

The Barrister will advise on the formation and licensing of Global Business Corporations (GBCs), authorised and registered funds under the Securities Act 2005, private equity fund structuring, and cross-border holding structures leveraging Mauritius's DTAA network. Appleby's global offshore platform — spanning Bermuda, Cayman, BVI, Jersey, and Seychelles — provides a multi-jurisdictional practice environment unavailable at any domestic Mauritius firm.

Responsibilities

  • Advise on GBC licensing applications and ongoing compliance with the Financial Services Act 2007
  • Structure investment funds (authorised, registered, and closed-end) under the Securities Act 2005
  • Draft fund offering documents, partnership agreements, and subscription documentation
  • Engage with the FSC on licensing, regulatory approvals, and compliance matters
  • Advise on Mauritius-India DTAA treaty benefits and substance requirements
  • Coordinate with Appleby offices globally on multi-jurisdictional fund structures

Requirements

  • Barrister admitted by the Mauritius Bar Council with minimum 7 years' post-admission experience
  • Specialist expertise in Global Business Corporation (GBC) structuring under the Financial Services Act 2007
  • Experience with investment fund formation under the Securities Act 2005 and FSC rules
  • Knowledge of private equity fund structures, carried interest arrangements, and limited partnership law
  • Understanding of the Mauritius-India DTAA and Africa treaty-based investment structuring
  • LL.B. from the University of Mauritius, UK, or equivalent; fund structuring qualification preferred
  • Excellent English drafting; French advantageous
